Delivery terms

Heursel will dispatch the goods by courier within the deadline communicated by confirmation e-mail and at the latest 30 calendar days after conclusion of the purchase and receipt of payment. Heursel cannot be held liable for non-compliance with the delivery period if this is due to force majeure or attributable to a third party such as the courier. If the delivery period threatens to be exceeded, Heursel will notify the buyer by e-mail and a new delivery period can be agreed. If he so wishes, the buyer can in that case renounce the purchase within 2 working days by e-mail. In that case, Heursel will refund the sums paid by the buyer, without interest or other compensation. In case of home delivery by Heursel to the Buyer, delivery on the ground floor applies.

Right of withdrawal

The buyer, as a consumer, has the right to withdraw from the purchase within 14 days from the day following the day of delivery, without payment of any penalty and without giving any reason. In this case, the items will be returned to Heursel at the latest 14 calendar days after prior notification of the withdrawal via e-mail, in the original and undamaged packaging, together with all accessories, instructions for use and invoice or proof of purchase. The return will take place at the expense and risk of the buyer. The buyer may not invoke this right in case of custom-made products. If the purchaser returns the items without accessories, or if the item is damaged because the purchaser has gone beyond mere inspection, Heursel will charge damages equal to the depreciation in value suffered by the item. 

Tips :

To exercise the right of withdrawal, the buyer shall notify Heursel of his withdrawal decision in writing by an unequivocal statement (e.g. by letter by post or by e-mail). The buyer may also use the model withdrawal form found on the website https://economie.fgov.be/sites/default/files/Files/Ventes/Forms/formulier-voor-herroeping.pdf.

After receiving the goods, Heursel will refund all payments received, without interest, to the buyer, including the delivery costs.

Warranty

Each item is subject to the legal warranty from the date of purchase by the first owner. Any commercial warranty does not affect these rights. If the product shows a visible defect upon delivery, the buyer must contact Heursel within 2 working days of its discovery, after which the buyer must return the article to Heursel without delay. In case of hidden defects, the buyer will have a period of at least 2 months after discovery of the hidden defect or after the time when such discovery could reasonably have been made to contact Heursel. The buyer will allow Heursel the necessary time to assess whether the defect is inherent to the article and was not caused by an external factor.

The costs of returning the item to which a visible or hidden defect has been detected will be borne by Heursel.

The (commercial and/or legal) warranty, which also applies to articles with a shorter lifespan or articles subject to wear and tear, never applies to defects caused by accidents, negligence, falls, abnormal or incorrect use, use of the article contrary to the purpose for which it was designed, non-compliance with the user instructions or manual, modifications or alterations to the article, heavy-handed use, poor maintenance.  Heursel will always verify on a case-by-case basis whether the defect occurring to the item is inherent to the item (e.g. a manufacturing defect) or was caused by the consumer. If the legal warranty does not apply, Heursel will provide a repair estimate in advance.

The legal warranty remains applicable if the consumer has had a repair or modification made to an article that is not related to the defect for which the consumer wishes to invoke the warranty.

Payment Methods

Terms of delivery

The purchaser has the option of purchasing the items in Heursel's range online subject to availability. Heursel is entitled to refuse orders, split deliveries, or attach other conditions to the delivery in the following cases :

in case of serious suspicion of abuse of law or bad faith of the purchaser
in case of suspicion that the buyer intends to resell the goods himself
in case of the observation of an abnormal quantity of reserved or ordered articles
upon exhaustion of stock or unavailability of an article
upon discovery of an invalid offer by the online shop
in the event of force majeure
The purchase is concluded when the buyer receives a confirmation e-mail from Heursel.

The items are delivered to the buyer only after full payment and remain the exclusive property of Heursel until then.

The buyer agrees that the data recorded on the webshop is proof of all transactions between Heursel and its customers. In the event of a dispute between Heursel and one of its customers regarding a transaction on the website, the data recorded by Heursel shall constitute irrefutable proof of the content of the transaction.

All Parties accept electronic evidence (e.g. e-mail, backups...) within the framework of their relationships.

Payment is made via one of the payment methods selected by the buyer during the order confirmation process.

Shipping costs are borne by the buyer and are displayed prior to the order. If it appears that the shipping cost cannot be calculated in advance, this will be communicated and Heursel reserves the right to charge this cost with the order confirmation e-mail.

Heursel will ship the goods via courier to the delivery address provided by the buyer. If the goods cannot be delivered to the address provided by the buyer, Heursel may charge an additional delivery fee for a second delivery.

The buyer signs for receipt of the delivery. The risk of loss or damage passes at the time of delivery of the goods to the buyer.

Upon receipt of the delivery, the buyer must check the packaging of the shipment. Visibly damaged packaging should be rejected with the indication "packaging damaged", otherwise the goods are presumed to be definitively accepted by the buyer as compliant.

Any visible and/or qualitative defect of an article must be reported in writing to Heursel immediately and at the latest 2 working days after receipt. After Heursel has received and accepted the rejected or faulty delivery, a new delivery will be sent at Heursel's expense and risk.
